Terms of service

Your account

You must give accurate information when you sign up and keep your password safe. The person who creates a workspace is its owner and is responsible for activity in it, including what teammates do.

Plans, trials, and billing

• The Free plan is free for one agent, with the limits shown on the pricing page.
• New workspaces receive a 10-day Pro trial without a credit card. If no paid plan is chosen, the workspace moves to Free when the trial ends.
• Paid plans are billed per agent, monthly or yearly, in advance, through Stripe. Seat and plan changes are prorated.
• You can cancel at any time; your plan stays active until the end of the paid period. Fees already paid are not refunded except where required by law.
• We may change prices with at least 30 days' notice. Changes apply from your next billing period.

Acceptable use

Don't use HiberChat to send spam, harass people, distribute malware, collect data without consent, impersonate others, or break the law. Don't try to access other customers' data, overload the service, or bypass plan limits. We may suspend workspaces that do.

Your content

You own the content you add — knowledge sources, messages, and files — and you're responsible for having the right to use it. You give us permission to host, process, and display it only to provide the service to you.

AI answers

The AI agent generates replies from the sources you provide. AI can be wrong. You're responsible for reviewing your knowledge sources and for answers given to your customers. Don't rely on the AI for legal, medical, or financial advice to your visitors.

Third-party services

Channels like Facebook Messenger and Instagram, and payment processing by Stripe, are governed by those providers' own terms.

Availability

We work hard to keep HiberChat running and publish live service health on our status page, but the service is provided as is, without a guaranteed uptime unless agreed in an Enterprise contract.

Liability

To the extent the law allows, HiberChat is not liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.

Ending the agreement

You can delete your workspace at any time. We may suspend or end access for serious or repeated breaches of these terms. You can export your data before your workspace is deleted.
